This Privacy Notice for Leon Mischlich (doing business as Transcribe • IT) describes how and why we might access, collect, store, use, and/or share your personal information when you use our services.

1. Who We Are

We are not required to designate a Data Protection Officer (DPO) under Art. 37 GDPR, as our core activity (transcription services) does not involve large-scale processing of special categories of personal data (Art. 9 GDPR).

Supervisory Authority: In each EU member state, a national supervisory authority is responsible for data protection.

2. What Information Do We Collect?

  • Account Data: Email addresses (via Firebase Authentication / Social Login) to manage your Pro subscription status.
  • Audio & Video Data: Files you voluntarily upload for transcription.
  • Device Data: IP address, device ID, operating system (collected automatically for security and rate limiting).
  • Usage & Analytics Data (Anonymous): We collect anonymous metrics to improve app stability and user experience.

3. How Do We Process Your Information?

We process your information to provide the following services:

  • Transcription: Audio/video files are encrypted in transit and sent to Groq, Inc. (USA) for speech-to-text processing. Files are deleted from Groq's systems immediately after transcription.
  • Summarization (Pro): Transcripts are sent to OpenAI, LLC (USA) for AI-powered summarization. Input content is NOT used to train OpenAI models.
  • Translation (Pro): Transcripts are sent to OpenAI, LLC (USA) for translation. Input content is NOT used to train OpenAI models.
  • Account Management: Firebase Authentication manages your account and subscription status.
  • Anonymous Analytics: Firebase Analytics records aggregate usage events without linking personal identifiers.

4. Detailed Analytics (Firebase)

We log specific events to understand how the app is used. No personal identifiers (like email or name) are linked to these events. You can disable this collection at any time in the App Settings > Usage Analysis.

  • General Interaction: App first open, session start, and screen views.
  • Feature Usage: Statistics on transcription starts (e.g., file count) and success (e.g., text length), as well as usage of AI features (Summarization, Translation).
  • Subscription Events: Interactions with the billing screen (e.g., clicking a price, subscription updates/cancellations via Google Play).
  • Performance & Stability: Startup time, API response times (HTTP status), and crash reports.

5. Legal Bases (GDPR)

We rely on the following legal bases to process your personal information:

  • Performance of a Contract (Art. 6(1)(b) GDPR): To deliver the transcription, summarization, and translation services you requested.
  • Consent (Art. 6(1)(a) GDPR): For optional analytics (which you can revoke via Settings at any time).
  • Legitimate Interests (Art. 6(1)(f) GDPR): To diagnose technical issues, prevent fraud, and improve the application's functionality based on anonymous usage patterns.

6. International Data Transfers

Some of our processors (Groq, Inc. and OpenAI, LLC) are based in the United States. Data transfers from the EU/EEA to these countries are covered by:

  • Standard Contractual Clauses (SCCs) as adopted by the European Commission, and/or
  • Adequacy decisions where applicable.

7. Sharing Your Information

We share data strictly with the following third-party vendors under Data Processing Addendums (DPAs):

  • Groq, Inc. (USA): Speech-to-Text processing.
  • OpenAI, LLC (USA): Translation and summarization.
  • Google Ireland Limited (Ireland): Firebase — Authentication, Database, Cloud Functions, and anonymous usage analysis.
AI & Data Training Your uploaded content and generated transcripts are NOT used to train the AI models of our providers (Groq/OpenAI).

8. Data Retention

  • Uploaded Audio/Video Files: Deleted from Groq's active processing buffers immediately after transcription is complete. We do not retain copies.
  • Transcripts: Stored locally on your device in an encrypted Room database. If you use Google Drive backup (Pro), transcripts are included in your personal Google Drive backup — we have no access to that data.
  • Firebase Authentication Data: Retained until you delete your account.
  • Anonymous Analytics: Aggregated data is retained for up to 14 months in accordance with Firebase Analytics data retention settings.

9. Data Security

All data in transit to our service providers is encrypted using TLS 1.2+. Audio/video files are sent directly to Groq for processing. We do not encrypt the audio content itself end-to-end before sending.

10. Your Privacy Rights

Under the GDPR, you have the following rights regarding your personal data:

  • Right of Access (Art. 15): Request a copy of your personal data.
  • Right to Rectification (Art. 16): Correct inaccurate data.
  • Right to Erasure (Art. 17): Request deletion of your data ("right to be forgotten").
  • Right to Restriction (Art. 18): Request restriction of processing.
  • Right to Data Portability (Art. 20): Receive your data in a structured, machine-readable format.
  • Right to Object (Art. 21): Object to processing based on legitimate interests.
  • Right to Withdraw Consent (Art. 7(3)): Revoke consent for optional analytics at any time in Settings.
  • Right to Lodge a Complaint (Art. 77): File a complaint with the supervisory authority in your EU country of residence.

11. Children's Privacy

Our services are not directed to children under 16 years of age. We do not knowingly collect personal data from minors. If you believe a child has provided us with personal data, please contact us and we will promptly delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last Updated" date within the app. Continued use of the service after changes constitutes acceptance of the revised policy.

By accessing or using Transcribe • IT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you are prohibited from using the Service.

1. About the Service

Transcribe • IT is an Android application that provides AI-powered transcription, summarization, and translation of audio and video files.

2. Eligibility & Age Restriction

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement. The Service is not intended for children under 16 years of age.

3. Services & Limitations

The Service provides the following AI-powered features:

  • Transcription: Converts audio/video files to text using Groq's speech-to-text API.
  • Summarization (Pro): Generates an AI-powered summary of your transcript using OpenAI.
  • Translation (Pro): Translates your transcript to a target language using OpenAI.

You acknowledge that:

  • Output quality depends on audio quality, speaker clarity, and language support.
  • The Service is not tailored for HIPAA, FISMA, or GDPR-specific compliance use cases beyond standard data processing.
  • AI outputs may contain errors, omissions, or hallucinations. Review all outputs before relying on them.

4. User Accounts

You must create an account to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions & Billing

The Service offers a Free tier and a Pro tier (monthly or yearly). Subscriptions are managed via Google Play. All payments are processed by Google; we have no control over payment disputes, refunds, or chargebacks.

  • You may cancel your subscription at any time via Google Play Store settings.
  • Refunds are governed exclusively by Google's refund policies.
  • We cannot cancel or modify subscriptions on your behalf.
  • Pro tier benefits (transcription minutes, summarization, translation) reset according to your billing cycle.

6. Your Content & Intellectual Property

Your Content: You retain full ownership of all audio/video files you upload and the transcripts, summaries, and translations generated from them ("Your Content"). You grant us a limited, non-exclusive license to process Your Content solely to provide the Service.

Data Deletion: When you delete your account, all associated data is permanently removed from our systems within 30 days. We do not retain backups of your data after deletion.

7. User Representations

You warrant that:

  • You have obtained all necessary consents from every individual who appears in or is audible in files you upload for transcription.
  • You will not use the Service to transcribe, summarize, or translate files that you are not authorized to process under applicable wiretapping, privacy, or data protection laws.
  • Your Content does not violate any third party's rights.

8. Prohibited Activities

You agree not to:

  • Reverse engineer, decompile, or disassemble the application.
  • Use the Free Tier to circumvent subscription limits (e.g., creating multiple accounts).
  • Generate content that is illegal, defamatory, or violates the rights of others.
  • Use the Service in a manner that exceeds rate limits or disrupts its availability.
  • Resell, redistribute, or sublicense access to the Service.
Disclaimer of Warranties THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI TRANSCRIPTIONS, SUMMARIES, OR TRANSLATIONS. AI MODELS ARE INHERENTLY NON-DETERMINISTIC AND MAY PRODUCE INCORRECT OR HALLUCINATED OUTPUTS. DO NOT USE AI OUTPUTS FOR PROFESSIONAL LEGAL, MEDICAL, OR SAFETY-CRITICAL DECISIONS WITHOUT INDEPENDENT VERIFICATION.

9. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the total amount paid by you to us in the six (6) months immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, regardless of the theory of liability.

10. Changes to the Service & Terms

We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We may also update these Terms from time to time. Material changes will be communicated via the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Hesse, Germany.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
